Fencepac is a leading supplier of fencing products on the Sunshine Coast and Brisbane. Recently one of our customers went into administration owing us a lot of money for work carried out on a building project. Peter advised us to make a claim against the owner of the project by making a claim under the Subcontractor's Charges Act.

Peter did all the work for us and Fencepac Commercial ended up being paid the full sum owing by the owner.

Peter Arthur of Mooloolaba Law served as legal counsel for us throughout 2012 as our Building & Construction Lawyer. During this period I served as the Chair Person of our Body Corporate Committee, representing 77 residential apartment owners. We were in conflict with the builder/developer over failures to rectify defects. Successive committees had failed to hold the builder to account and years of stalling tactics and 'band-aid' fixes had left owners exasperated!

Following telephone calls and interviews with prospective solicitors, a unanimous decision was taken by our Body Corporate to engage Peter Arthur. At the time of engaging Peter, the normal builder's 'warranty period' had expired, but Peter's thorough investigative research and his explicit advice opened avenues for us to gain redress that we were previously unaware of. A significant proportion of the problems were repaired as a result, with more rectification work to come.

The committee found Peter Arthur to have an excellent command of the law. He worked diligently to gain a firm understanding of the complex history of the relationship between the owners, the builder and two insurance companies. On behalf of the committee and the owners I express my appreciation for the professionalism of Peter's advice and his skills in negotiating favourable outcomes for us.

We operate a mid-sized heavy earthmoving business in the Bowen Basin and Mackay. We have used Pete for all our matters since our association began some 12 years ago. Over the last few years we've had disputes involving The Building and Construction Industry Payments Act (BCIPA) which is pretty complicated, but Peter was able to explain it to us and guide us through a number of disputes, which resulted in successful outcomes, that might otherwise have taken years to sort out!. I have used Peter Arthur over the years when he was based in Mackay and have had successful conclusions in all cases. Only one case actually made it to the courtroom as Peter worked diligently to resolve the issues before a court appearance was necessary. All cases were completely different. One involved a challenge on an unscrupulous franchisor and another where Mother Nature had caused damage to a driveway that I had constructed and I was seen as the blame.
